This sounds really stressful, and I’m sorry you’re stuck in the middle like this. When cybercrime puts a hold on an account, banks usually won’t remove it until they get a clear “no objection” or closure update from the police/cyber cell mentioned in the complaint copy, even if the transaction shown is failed or doesn’t exist in your statement.

Since HDFC and customer care also confirmed that the transaction never reached your account, the next step is usually to get clarity from the same police station/cyber unit mentioned in the complaint copy, not the one nearest to you. Only they can update or withdraw the complaint. Most banks can’t unfreeze the account unless they receive that official communication.

If the SHO there is asking for a court order, it means they aren’t willing to close the complaint from their side. In such cases, people usually have 2 practical options:
  • Request the investigating officer to issue a letter stating that the complaint was filed by mistake/transaction failed/your account is not involved,
    or
  • Approach a court to get an order to unfreeze the account.
Before going to court, I’d still suggest trying to speak again to the cyber officer/SHO mentioned in the document, sometimes they cooperate once you show your account statement and explain clearly. Otherwise, going to court might be the last option and it can help you

Your 60k being stuck is understandable, did HDFC tell you if the entire account is frozen or only a partial hold? That can also help in deciding the next steps.
